Terms of Service

These Terms govern your use of Retention IQ, Revenue IQ, and Refi IQ ("Services") operated by TechStack LLC ("TechStack," "we," "us").
1. Your account
You are responsible for safeguarding your credentials and for any activity under your account. Notify us immediately of any unauthorized use at hello@techstackllc.info. Accounts are per-individual; sharing is not permitted.
2. Your data
You retain all rights to the client data you upload ("Customer Data"). You grant us a limited license to process Customer Data solely to deliver the Services. We do not sell Customer Data and do not share it with third parties except as stated in the Privacy Policy. You warrant that you have the right to upload any Customer Data and to engage in outreach using it.
3. Acceptable use
You agree not to:
- Use the Services to send unsolicited communications in violation of CAN-SPAM, TCPA, or other applicable law.
- Attempt to reverse engineer, scrape, or disrupt the Services.
- Use the Services to target clients in ways that violate RESPA, TILA, ECOA, Fair Housing, or equivalent laws.
- Share account credentials.
4. Subscriptions & billing
Plans are month-to-month unless otherwise agreed. Performance plans bill a monthly base plus a per-attribution fee on confirmed recovered bookings/deals, capped at the monthly cap stated on your plan. Flat plans bill a fixed monthly fee. Fees are non-refundable except as required by law or stated in writing. We may change pricing with 30 days notice; existing subscriptions honor then-current pricing for 90 days after notice.
5. Performance attribution
Performance plan fees are triggered by attributions you confirm in the Attribution tab. You may dispute any attribution; disputed attributions are dropped and not billed. We rely on your confirmation in good faith. Where we detect clearly erroneous confirmations we reserve the right to reverse them.
6. HIPAA and regulated industries
For customers subject to HIPAA: you must execute a Business Associate Agreement with us before uploading Protected Health Information. For customers subject to mortgage regulation: you are the regulated party. Our tool generates drafts; you are solely responsible for compliance with RESPA, TILA, TCPA, ECOA, Fair Housing, and all state-level regimes before any communication leaves your control.
7. Uptime and support
We aim for 99.5% monthly uptime. Scheduled maintenance is communicated in advance. Support is provided via email at hello@techstackllc.info; Boutique and Enterprise tiers include dedicated customer success.
8. Termination
Either party may terminate at any time with notice via the cancellation flow or email. On termination: your access ends at the end of the current billing period; your Customer Data is available for export for 30 days, after which we delete it per the retention policy in our Privacy Policy.
9. Warranties & limitation
The Services are provided "as is." We disclaim all warranties except as required by law. Our aggregate liability to you for any claim is limited to the greater of: (a) the fees you paid us in the 12 months preceding the claim, or (b) $10,000. We are not liable for consequential, indirect, or special damages.
10. Indemnification
You will indemnify TechStack from claims arising out of your violation of these Terms, your Customer Data, your outreach activities, or your violation of any applicable law.
11. Disputes
These Terms are governed by Texas law. Disputes will be resolved by binding arbitration in Travis County, TX, except for claims that qualify for small-claims court. Class actions are waived.
12. Changes
We may update these Terms. Material changes will be communicated by email and posted here with a new "Last updated" date.
